Any disputes that might be arising as to the interpretation of the terms and conditions under this agreement and/or to the contents stated in this Website and/or as to the determination of the rights and obligations of the users and the owner/associates of this Website herein shall be settled by the way of referring such disputes to arbitration by the sole Arbitrator appointed by the authorities of KMCC KERALA TRUST.
All statements and private information under the website https://www.mykmcc.org are sought for by KMCC KERALA TRUST (referred as KMCC) with a view to augment its service levels to the users including KMCC members and KMCC security scheme members (from now on referred as members or users). Members or non-members who opt to avail the services of KMCC and services from this website shall provide the required information. The information collected under this website shall be kept in absolute confidence and trust for internal operations purposes to provide services to members. We neither intend to substitute the records of the members/users nor guarantee preservation of the same indefinitely. Though we can maintain the secrecy of personal information, we shall not be liable or accountable for the loss and/or pilferage of information due to any reason whatsoever.
KMCC reserves their right to either to keep
the personal information or to delete the same. Members shall part with their
personal information at their risk and cost, and accordingly KMCC shall not be
held liable for any loss of data and the pilferage of information. The law
applicable shall be Indian Law and the venue of the Arbitration shall be at Kozhikode,
Kerala, India. The award to be passed by the Arbitrator shall be final and
binding on the parties herein. Only Courts in Kozhikode alone shall have
exclusive jurisdiction to try all consequential proceedings if any that might
be arising from the award.
